2001 325i touring AW/BLK 5spd

I have a 01 325i touring for sale. I originally pick this up for drive as daily and eventually planning on doing LSx swap. I really like this car and you don't see it often on the road but I found a bike that I want so this one has to go!!

Here is run down of my car.

-AW exterior w/ black int (rare combo)
-rare 5spd
-M-tech II front bumper
-factory HID
-108k miles
-Runs and drives good.
-new OEM clear rear inner and outer(have receipt)
-new OEM key (have receipt)
-new coded lock cylinder (have receipt)
-clear corner and side marker
-black kidney grill
-sport spring
-17" sport wheels
-everything works except keyless entry
-Dice Electronic Ipod hookup in center console
-new OEM no license holder bumper trim

Exterior and interior is in good shape other than A pillar liner is coming off at the bottom(see pic)

When I bought the car key wasn't working, missing one grill. PO took key apart to put new battery in it and key looked butchered up so I bought new key. Dealer attempted to sync my key but no dice. since key cylinder was bad on driver side I replaced with new one. Now you can lock/unlock using the key from outside the car. Central lock works fine.

Bad:
-crack in windshield. Right down the middle of window
-rear driver side window does not work
-little scrape on bottom of front bumper
-leaks little oil from oil filter housing.
-small rust spot on pass fender (see the pic)
-cracked intake boot (common issue)
-3rd gear pops out occasionally while coasting.

KBB said anywhere from $5.8k (fair) to $7.2k (excellent)

So you have to put the key in the door for it to work but the buttons on the keys dont work? is that right?
Im a couple hours south in KY and interested. How often does the tranny pop out? Ive had an e36 that had the same deal and ended up replacing the tranny.
